Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Menu Plus platform, website, and related services (the "Service"), operated by Insightfy ( https://insightfy.app), "we", "us", or "our". Menu Plus is one of Insightfy's products.
By creating an account, subscribing to a plan, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. The Service
Menu Plusprovides digital menu management, ordering, and related tools for restaurants and food businesses ("Restaurant Accounts") and, where a Restaurant Account enables it, an ordering experience for that restaurant's customers ("Guests").
We may add, change, or remove features from time to time. We will try to give reasonable notice of changes that materially reduce functionality you rely on.
2. Accounts & Eligibility
- You must provide accurate, current information when creating a Restaurant Account and keep it up to date.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You must have authority to bind the restaurant or business you represent to these Terms.
- Notify us immediately at info@menuplus.co if you suspect unauthorized use of your account.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable regulation.
- Upload menu content that is fraudulent, misleading, or infringes a third party's rights.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Interfere with or disrupt the integrity or performance of the Service (e.g. scraping at scale, denial-of-service activity).
- Reverse engineer or resell the Service without our written consent.
We may suspend or terminate accounts that violate this section, as described in Section 8 (Termination).
4. Subscription Plans & Billing
Paid plans are arranged with our team and billed on the cycle agreed at signup (e.g. monthly or annually). By subscribing, you authorize us to charge the agreed fees to your chosen payment method for each billing cycle until the subscription is cancelled.
Cancellations, and whether any amount is refundable, are governed by our Refund Policy. In short: you can cancel at any time to stop future charges; amounts already charged are non-refundable except where our Refund Policy says otherwise.
We may change plan pricing going forward. We will give you reasonable notice before a price change takes effect on your account.
5. Content & Intellectual Property
- Your content: you retain ownership of the menu items, descriptions, images, and other content you upload ("Restaurant Content"). You grant us a license to host, display, and process it solely to provide the Service.
- Our platform: the Menu Plus software, branding, and underlying technology are owned by Insightfyand protected by intellectual property law. These Terms do not grant you any rights to our trademarks or source code.
- You are responsible for ensuring Restaurant Content does not infringe third-party rights (e.g. photos, recipes, or names you do not have rights to use).
6. Third-Party Services
The Service relies on third-party providers such as Firebase (push notifications, analytics), cloud hosting, and payment processors, as described in our Privacy Policy. We are not responsible for outages or issues caused by these third parties, though we will make reasonable efforts to minimize impact on your use of the Service.
7. Disclaimers & Limitation of Liability
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement.
To the maximum extent permitted by law, Insightfy will not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 3 months preceding the claim.
8. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your account if you materially breach these Terms, misuse the Service, or fail to pay amounts owed, generally after giving you notice and a reasonable opportunity to fix the issue where practical.
Upon termination, your right to use the Service ends. We will handle any personal data retained after termination as described in our Privacy Policy.
9. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Effective date" above and notify registered users via email or an in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
